Indonesia flag carrier PT Garuda Indonesia Tbk on Dec. 30 filed a lawsuit against lessors Greylag Goose Leasing and Greylag Goose Leasing Designated Activity Company to the Central Jakarta Commercial Court, and is requesting that the court declare both defendants in contempt of court, while seeking to force them to drop any efforts to seek payment outside the composition plan sanctioned by the court on June 17, 2022, according to a
court document (Bahasa Indonesia).
The lawsuit also seeks to force both lessors to accept an Airbus A330-200 plane with series number 1410 and an Airbus A330-300 plane with series number 1412, that had been returned as part of the plaintiff’s fulfillment of obligations as sanctioned by the Central Jakarta court on June 22, 2022, the document states.
The lawsuit also seeks material damages amounting to IDR 14.25 billion ($912,965) for aircraft maintenance and insurance costs, as well as non-material damages amounting to IDR 10 trillion for damages to Garuda’s reputation, according to the court document.
Daniel Alfredo is Garuda’s legal representative in the lawsuit, the document details.
As
reported, Garuda announced that its court-sanctioned composition plan was to take effect on Jan. 1, following the fulfillment of all conditions precedent including issuance of new bond and sukuk certificates on Dec. 28 and 29, respectively, and entering into an amended Airbus Purchase Agreement.
The Greylag entities have
filed an objection to the U.S. Bankruptcy Court for the Southern District of New York against the enforcement of in-court debt restructuring (PKPU) plan under Chapter 15, with the next court hearing scheduled to take place on Jan. 12 at 10 a.m. Eastern Time.
