The Dutch scheme of arrangement - Wet homologatie onderhands akkoord, or “WHOA” - will enter into force in the Netherlands on Jan. 1. The Dutch scheme is designed to be a fast and efficient pre-insolvency procedure which can be used to restructure a group’s debt. The process has borrowed from both the U.K. scheme of arrangement and the U.S. chapter 11 process.

A Reorg Primer on the new tool, including comparisons to the U.K. scheme process can be found HERE.

Reorg’s podcast on the new Dutch Scheme, featuring Nico Tollenaar, Partner at Law firm, RESOR in Amsterdam, is available on the Reorg Media Page. The podcast is also available on SoundCloud and on iTunes.
