The Dutch scheme of arrangement - Wet homologatie onderhands akkoord, or “WHOA” - will enter into force in the Netherlands on Jan. 1. The Dutch scheme is designed to be a fast and efficient pre-insolvency procedure which can be used to restructure a group’s debt. The process has borrowed from both the U.K. scheme of arrangement and the U.S. chapter 11 process.
